MCI Spain complies with the requirements established in Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, and other European regulations, and to this end has created the following Legal Notice. The purpose of these conditions is to communicate the mode of access and use by the public/users of the content and services offered by the website. MCI Spain informs that use of the portal, including mere access, confers the status of User. In this respect the User undertakes to use the portal in accordance with the law, with this Legal Notice, regulations and instructions made known to him/her, as well as with morality, generally accepted good practice and public order. If the user does not agree with any of the conditions set out herein, he/she must not use/access this portal.

 

INTELLECTUAL AND INDUSTRIAL PROPERTY

 This Legal Notice does not assign any intellectual or industrial property rights over the website or any of its constituent elements. The User is prohibited to perform any act of reproduction, transformation, distribution, public communication, making available, extraction, reuse, resending or use of any nature, by any means or procedure, of any of the Contents, except in those cases in which it is legally permitted or authorised in writing by the owner of the corresponding rights. Any presence on this site of distinctive signs owned by third parties other than MCI Spain is for non-commercial purposes and with the authorisation of their legitimate owners, always with due respect for their exclusive trademark rights. Access to the Portal requires services and supplies from third parties, including transfer via telecommunication networks whose reliability, quality, continuity and operation is not responsibility of MCI Spain. MCI Spain therefore does not guarantee the availability and continuity of the operation of the Portal, the Services and/or the Content and accepts no liability whatsoever for damages of any kind that may be due to the lack of such availability or continuity.

 

2.- PORTAL SECURITY

MCI Spain adopts reasonably adequate security measures but cannot guarantee the absolute invulnerability of the security systems of the Portal and the Services, nor can it guarantee the security or inviolability of such data in their transmission over the network; the User must be aware that the security measures of computer systems on the Internet are not entirely reliable. All liability is therefore excluded for damages of any kind which may be due to the knowledge which unauthorised third parties may have of the type, conditions, characteristics, and circumstances of the users of the Portal, the Services and/or the Content.

MCI Spain neither controls nor guarantees the absence of viruses, worms or other elements in the Content which may cause alterations to User´s computer system (hardware and software) or to the electronic documents and files stored in his/her computer system. It is the User’s responsibility, in all cases, to ensure the availability of suitable tools for the detection and disinfection of harmful computer programmes. MCI Spain excludes all liability for damages of any kind which may be due to the presence of these viruses or harmful elements in the Content.

 

3.- USE BY THE USER

MCI Spain does not control the use made by users of the Portal, the Services and/or the Content and therefore does not guarantee that the use made by them is in accordance with the law and these general terms and conditions. MCI Spain excludes any liability for damages of any kind that may be due to the use of the Portal, Services and Content by users.

The above list is merely enunciative in nature and is in no case exclusive or excluding in any of its points. In all cases, MCI Spain excludes any liability for damages of any nature arising directly or indirectly from the same and any other unspecified damages of a similar nature.

APPLICABLE LEGISLATION

The terms and conditions governing this website and all relations that may arise from it are governed by Spanish law. Any dispute that may arise from accessing or using this website shall be submitted to Spanish jurisdiction, with the parties submitting themselves to the Courts and Tribunals of the city of Madrid, expressly waiving their jurisdictions if different from those mentioned above.84
